Hello All,
I have my EAD as does my wife. We are still on valid H1s (until 2009) and I have no plans to change my employer. We also received our travel documents. The question I have, and need your input on is can my wife travel (to India) and back on her H4 (even though we've filed for adjustment of status) or does she have to use her Advance Parole to do so?

It is possible. There is a relatively unknown technique called TT (abbreviation for Time Travel) which is also relatively related to relativity. When applied correctly, it is more effective than PD recapturing and labor substitution. That's how I got my green. Folks,
I did not face this problem because i had a physical Birth Certificate here at US and i Notarized it by American Notary ( Bank of America ) before sending for 485 last July 07
Now for my wife the birth Certificate is physically at India - my father in law is feeling nervous to send the Original by Post - you know how tough it is to get another original BC at India unlike USA where my son has 4-5 original BC for 50 bucks :)
So i was wondering if a Notarization from India would work for 485 purpose ?

Hello,
I have recently moved from Company A(where I worked for 6 years of which last 4 years was in US on H1B) to Company B(working here for 6 months). My H1B transfer is complete but my VISA needs stamping. I need to travel to UK for 2-3 days next week.
Am I eligible to get the Visa stamping done in London? If so, is this a high risk option? How do you compare the risk of the option with the risk of alternate in making a trip to India from UK to get my Visa stamped? Does the fact that my current job is with a smaller(200 to 500 employees) IT consulting firm add to the risk significantly?
Do you think it is possible to get stamping dates around Dec 12-13?
In case VISA gets rejected in UK, what are the chances I can go back to India and get it stamped after that? And how long will that take on average?

I have applied concurrently for green card under EB2 in August 2007.Received I140 approval and I485 is in process. Have applied for H1b extension and is pending. I am working for a consulting firm at present. I got job offer for a permanent position with the client that has same job duties and title. But the salary is about $20, 000 lower than what my consulting firm is paying now. My labor was applied with a higher salary. Can this lower salary and the difference create problems with the green card processing? Did anyone have any of this experience? Please help!!!
Yes, lower salary by that much will be a basis of denial of your I-485. Your new position must have at least the salary mentioned in the LC.

My brother graduated in Dec 08 and is on OPT now. He is with a consultant and he was wondering if there is any rule which states that folks on OPT should get a job in 3 months, otherwise the OPT will not be valid.
Can any one please clarify.

There is likely to be a change in my reporting manager. My current reporting manager will still be in the company in a new role, but I will be reporting to a new manager.
My PERM application (LC) was filed in mid Jan '09, and is still being processed. I would like to know if this will affect my PERM application in any way.
Nothing else has changed since i took up this position, same title, salary, location etc.,

Actually stay outside the country does not constitute towards bench time. So if you are outside country - you are not in bench. One American Consulting company I used to work for way back in 2001 - used to move benched candidates to Canada (if they need to be benched for long time) and then bring them back when they get a project.
Please remember that you may be asked to prove you have a project at POE so when you come back have copies of contract to prove it.

I have just gone thru March recording of IV lawyer call and the below caught my attention. Ms Susan mentioned that any company name change after I140 approval has to refile I 140. I am utterly confused as that particular scenario affect me and i would like to know what best course of action i can take at this point.
I filed LC and I 140 with company A
My I 140 got approved
Before i filed my I 485 my company changed its name
I asked my attorney at that time if we need to take any special action
Attorney said they can just add an amendment while applying for I 485 about name change and apply with approved I 140, which is with old company name.

I efiled on April 7th and got FP notice on April 15th or so with appointment date of April 30th. Hope this helps.
